These Terms of Service ("Terms") govern your use of the 101Hired web application operated by 101Hired ("we," "our," or "us"). By creating an account or using the service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use 101Hired. By using the service, you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate information when creating your account and to keep it up to date.

3. Acceptable Use

You agree not to:

  • Upload content you do not have the right to use (including copyrighted material owned by others)
  • Use the service for any illegal purpose or in violation of any applicable law
  • Attempt to access other users' data or interfere with the service's operation
  • Reverse engineer, decompile, or attempt to extract the source code of the service
  • Use automated tools to scrape, crawl, or extract data from the service
  • Upload malicious content including viruses, malware, or harmful code

4. User Content

You retain ownership of content you upload to 101Hired, including resumes, job descriptions, and any other materials. By uploading content, you grant us a limited, non-exclusive license to process and store it solely for the purpose of providing the service to you.

You represent and warrant that you have all necessary rights to the content you upload and that your content does not infringe on any third party's intellectual property rights.

5. Copyright Infringement and DMCA

We respect intellectual property rights and expect our users to do the same. If you believe that content on 101Hired infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your notice must include:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material on 101Hired that you claim is infringing, with enough detail for us to locate it
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

Upon receiving a valid DMCA notice, we will remove or disable access to the allegedly infringing material and notify the user who uploaded it. Repeat infringers will have their accounts terminated.

6. Intellectual Property

The 101Hired service, including its design, layout, text, graphics, software, and all other content ("Service Content"), is owned by 101Hired or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to access and use the service for your personal, non-commercial interview preparation purposes.

You may not:

  • Reproduce, distribute, modify, or create derivative works of any Service Content
  • Download, store, or transmit any Service Content except as incidental to normal use of the service
  • Remove or alter any copyright, trademark, or other proprietary notices from the service
  • Use the service or its content for any commercial purpose without our written consent

7. Subscriptions and Billing

101Hired offers paid subscription plans (Pro and Expert) billed on a recurring monthly basis. By subscribing to a paid plan:

  • You authorize us to charge the payment method you provide on a recurring basis at the then-current rate for your selected plan
  • Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
  • You can cancel your subscription at any time from your account settings page; your plan will remain active until the end of the current billing period
  • All subscription fees are non-refundable. Once a payment has been processed, no refunds will be provided regardless of the reason for cancellation or termination. By subscribing, you acknowledge and agree to this non-refundability policy.

Prices may change with at least 30 days' notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

8. Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. After cancellation, your account will revert to the free plan. You will not be charged again after cancellation.

9. AI-Generated Content

101Hired uses artificial intelligence to generate interview questions, feedback, answer rewrites, and coaching content. This content is generated automatically and is provided for educational and practice purposes only. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific interview or employment situation.

10. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We do not guarantee any specific outcome from using the service, including job offers or interview performance.

11. Limitation of Liability

To the maximum extent permitted by law, 101Hired shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill. Our total aggregate liability for any claims arising from your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless 101Hired from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the service, your violation of these Terms, or your infringement of any third party's rights.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

14. External Links

The service may contain links to third-party websites or services (such as Stripe for payments and Google for authentication). These linked services are not under our control, and we are not responsible for their content, privacy practices, or availability. Your use of third-party services is governed by their respective terms and conditions. We provide these links only as a convenience and do not endorse or warrant any third-party services.

15. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Informal Resolution

If you have a dispute with us, you agree to first contact us at 101hired@gmail.com and attempt to resolve the dispute informally for at least 60 days before initiating any formal proceedings.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class action, consolidated action, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against 101Hired.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the service after changes constitutes your acceptance of the new Terms.

17. Assignment

You may not transfer or assign these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 101Hired concerning the service and supersede all prior agreements, understandings, or representations regarding the service.
